Agreement to Terms
These Terms of Use ("Terms") constitute a legally binding agreement between you and Atomic Doctor, LLC ("Company," "we," "us," or "our") regarding your access to and use of our healthcare platform and services.
By accessing or using Atomic Doctor, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use our services.
Description of Services
Atomic Doctor, LLC is a healthcare technology platform that connects patients with licensed physicians for telehealth consultations. Our services include:

- •Secure messaging with physicians
- •Electronic medical records and health information storage
- •Prescription services (where permitted by law)
- •Physician directory and matching

ATOMIC DOCTOR IS NOT A HEALTHCARE PROVIDER. We are a technology platform that facilitates connections between patients and independent physicians.
Payment Terms
Consultation Fees: Physicians set their own consultation rates. You agree to pay the consultation fee as displayed at the time of booking.
Billing: Consultations are billed in 12-minute increments, up to the nearest increment. Payment is processed immediately after the consultation ends.
Platform Fee: Atomic Doctor, LLC charges physicians a 20% platform fee, which is already included in the consultation rate shown to patients.
Prescription Fee: A $1 service fee applies when a prescription is written.
Refunds: Refunds are handled on a case-by-case basis. Contact our support team to request a refund.
Payment Methods: We accept major credit cards and debit cards. You authorize us to charge your payment method for all fees incurred.

You agree NOT to:
User Accounts
Account Creation: You must create an account to use our services. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
Account Security: You must immediately notify us of any unauthorized access to or use of your account. We are not liable for any losses resulting from unauthorized account use.
Account Accuracy: You agree to provide accurate, current, and complete information and to update such information as necessary to maintain its accuracy.
Account Termination: We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent, illegal, or abusive conduct.
Intellectual Property
All content, features, and functionality of Atomic Doctor, LLC, including but not limited to text, graphics, logos, images, software, and design, are owned by Atomic Doctor, LLC and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works from our platform without our express written permission.
Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW: Atomic Doctor, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses, resulting from your use or inability to use our services, any unauthorized access to your account or information, any errors or omissions in content, or medical treatment provided by physicians. Our total liability shall not exceed the amount you paid to Atomic Doctor, LLC in the 12 months preceding the claim.
Indemnification
You agree to indemnify, defend, and hold harmless Atomic Doctor, LLC, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from your use of our services, your violation of these Terms, your violation of any rights of another person or entity, or any content you submit through our platform.
Dispute Resolution
Any disputes that cannot be resolved informally shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to resolve disputes on an individual basis only and waive any right to participate in class actions. These Terms shall be governed by and construed in accordance with the laws of the State of Delaware.
Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by email or through a prominent notice on our platform. Your continued use of our services after changes become effective constitutes acceptance of the updated Terms.
Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
